NOCTURNAL TERMS & CONDITIONS
General Terms
1.1. These Terms and Conditions ("Terms") govern the purchase of memberships, tickets and participation in experiences organised by Nocturnal ("Company").
1.2. Nocturnal is a private membership community that curates social gatherings, cultural experiences, immersive events, educational workshops, retreats, performances, discussions and hospitality experiences for adults.
1.3. By purchasing a membership, ticket or attending an event, you agree to comply with these Terms.
1.4. The Company reserves the right to amend these Terms at any time. Updated Terms become effective immediately upon publication.
Eligibility
2.1. All participants must be at least 18 years of age.
2.2. Certain experiences may have additional eligibility requirements which will be outlined at the time of booking.
2.3. Access to some events, retreats and private experiences may be limited to approved members.
Memberships, Tickets & Transfers
3.1. Memberships and event tickets must be purchased through Nocturnal's official channels.
3.2. Membership fees provide access to the Nocturnal community and associated member benefits. Membership does not guarantee admission to every event.
3.3. Ticket purchases are non-refundable unless cancellation is requested at least seven (7) days prior to the event.
3.4. Tickets may be transferred to another eligible attendee with written approval from Nocturnal at least forty-eight (48) hours prior to the event.
3.5. Nocturnal is not responsible for private ticket transfers or resale arrangements.
Community Standards & Conduct
4.1. Nocturnal is committed to fostering a respectful, inclusive and welcoming environment.
4.2. Attendees are expected to treat fellow members, guests, venues and staff with courtesy and respect.
4.3. Harassment, discrimination, threatening behaviour, unwanted advances, disruptive conduct or unlawful activity will not be tolerated.
4.4. The Company reserves the right to refuse admission or remove any attendee without refund where conduct is deemed inappropriate, unsafe or inconsistent with community standards.
4.5. Members and attendees are responsible for maintaining respectful personal boundaries and interactions at all times.
Health & Safety
5.1. Attendees participate in events at their own risk and are responsible for their own wellbeing.
5.2. Nocturnal takes reasonable measures to provide a safe environment but cannot guarantee against all risks associated with attendance.
5.3. Alcohol may be served at certain events. Attendees are expected to consume responsibly and comply with all applicable laws.
5.4. The Company reserves the right to refuse service or remove any attendee whose behaviour presents a risk to themselves or others.
Privacy & Confidentiality
6.1. Nocturnal values discretion and respects the privacy of its members and guests.
6.2. Personal information will be handled in accordance with applicable privacy laws.
6.3. Photography, filming and recording may be restricted at certain events to protect the privacy of attendees.
6.4. Members and guests agree not to share confidential information about other attendees without their consent.
Event Changes, Cancellation & Postponement
7.1. Nocturnal reserves the right to modify, postpone or cancel events where necessary due to circumstances beyond its control, including venue issues, health and safety concerns, weather events or operational requirements.
7.2. Where an event is cancelled by Nocturnal, attendees may be offered a transfer, credit or refund at the Company's discretion.
Liability
8.1. To the fullest extent permitted by law, Nocturnal is not liable for personal injury, loss, theft, damage to property or any indirect or consequential loss arising from attendance at an event or participation in a membership program.
8.2. Attendees assume responsibility for their own decisions, conduct and interactions during events and experiences.
8.3. By attending a Nocturnal event, you release the Company from claims arising from your voluntary participation, except where liability cannot legally be excluded.
Governing Law
9.1. These Terms are governed by the laws of Victoria, Australia.
9.2. Any dispute arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
